General Terms and Conditions of Sale

1. Purpose and Identification
These General Terms and Conditions of Sale (GTC) govern the sale of automated web audit services via the Oplia SaaS platform.

2. Services Offered
Oplia provides a SaaS service for generating performance, SEO, and web quality audits. Reports are delivered digitally (dashboard and PDF files).
- Starter Plan: 20 audits/month
- Pro Plan: 100 audits/month, simultaneous analyses, white label reports
- Agence Plan: 400 audits/month, bulk import, API
The service is accessible 24/7, subject to scheduled maintenance or technical incidents.
3. Orders and Account
To access the services, the Client must create a user account. Ordering a subscription follows these steps:
- Selection of the desired subscription plan
- Secure payment by credit card (via Stripe)
- Automatic creation of the client account
- Order confirmation by email
Order validation constitutes unreserved acceptance of these GTC.
4. Rates and Billing
Rates are indicated in euros. In accordance with the Seller's tax status, VAT is not applicable (art. 293 B of the CGI).
Payment is due immediately upon order. The subscription is billed monthly by automatic debit via our secure payment provider Stripe.
Electronic Invoicing: By subscribing to the service, the Client expressly agrees to receive invoices only electronically. Invoices are sent automatically by email after each payment and remain accessible via the client area (Stripe billing portal).
Thomas DE ALMEIDA reserves the right to modify prices and offer content at any time. Current subscriptions will be billed at the rate and conditions in effect at the time of subscription until renewal. In the event of a price increase or substantial modification of the service, the Client will be informed at least 30 days in advance and may cancel without charge.
5. Duration, Cancellation, and Refund
Subscriptions have no duration commitment and are tacitly renewed each month.
The Client can cancel at any time from their client area. Cancellation takes effect at the end of the current monthly period. Any month started is due and will not be subject to any pro-rated refund.
6. Right of Withdrawal (Digital Content)
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a physical medium whose execution has begun after the consumer's express prior agreement and express waiver of their right of withdrawal.
By subscribing to an Oplia subscription and using the service (generating audits), the Client accepts the immediate execution of the contract and expressly waives their right of withdrawal.
7. Liability and Obligations
Oplia's Obligation: Oplia is bound by an obligation of means. We make every effort to provide accurate analyses based on recognized tools (Lighthouse, etc.), but do not guarantee that recommendations will achieve a specific ranking or performance (obligation of results excluded).
Limitation: Thomas DE ALMEIDA's liability cannot be engaged for indirect damages, loss of data, loss of revenue, or loss of operation. In any event, liability is limited to the amount paid by the Client over the last 12 months.
8. Intellectual Property
Reports and audits generated are the property of the Client, who has a free right of use.
The Oplia platform, its source code, design, and databases remain the exclusive property of Thomas DE ALMEIDA.
9. Personal Data and Bloctel
Data is processed in accordance with the GDPR. For more details, consult our Privacy Policy. The Client has a right of access and rectification by writing to contact@oplia.fr.
Telephone Solicitation: We inform the Client that if they have provided their telephone number, they have the possibility of registering for free on the Bloctel telephone solicitation opposition list (www.bloctel.gouv.fr).
10. Disputes and Mediation
In the event of a dispute, an amicable solution will be sought before any legal action. These GTC are subject to French law.
Mediation: In accordance with articles L.616-1 and R.616-1 of the Consumer Code, the Seller is required to communicate the contact details of the consumer mediator to which they belong.
To date, the mediator appointment process is underway. In the event of a dispute not resolved by a prior claim to customer service, the Client is invited to contact the Seller to obtain the contact details of the appointed mediator.
In the absence of an amicable agreement, any dispute will be brought before the competent courts.
